Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and Listybitsy (“we”, “us”) governing your access to and use of listybitsy.com and related services (the “Service”). The Service is operated from Ireland and made available globally. By creating an account or otherwise using the Service from any country, you accept these Terms. If you are using the Service from a jurisdiction whose mandatory consumer-protection law gives you stronger rights than these Terms, those mandatory rights still apply to you.

1. The Service

Listybitsy uses AI (Anthropic's Claude models) to generate Etsy-optimised listing titles, descriptions, tags, and SEO scores from product photos and text you provide. The Pro plan also lets you publish a generated listing to your connected Etsy shop.

2. Eligibility

You must be at least 16 years old and capable of entering into a binding contract. By using the Service you confirm you meet these requirements.

3. Your account

• You are responsible for the email address used to sign in and for keeping access to that mailbox secure.
• You are responsible for all activity under your account.
• One account per person; we may suspend duplicate accounts created to circumvent plan limits.

4. Plans, billing, and refunds

• The Free plan includes 3 listings per calendar month. Creator and Pro plans include the listing limits stated on /pricing. We may change plan features and prices on at least 14 days' notice; existing prepaid periods are honoured at the original price.
• Paid plans are billed monthly via Stripe. By starting a subscription you authorise recurring charges until you cancel.
• You can cancel at any time from the billing portal; cancellation takes effect at the end of the current billing period.
• Refunds. Because the Service is digital and substantially used immediately, we do not offer refunds for partial months. EU/UK consumers retain any non-waivable statutory rights of withdrawal.
• You are responsible for any taxes that apply in your jurisdiction. Stripe collects VAT where required.

5. Acceptable use

You agree not to:

• Upload content you do not have the rights to (someone else's photos, copyrighted material you do not own or license).
• Use the Service to generate listings for prohibited goods (counterfeit goods, illegal items, items that violate Etsy's policies, etc.).
• Reverse-engineer, scrape, or attempt to extract underlying prompts, models, or system internals.
• Use the Service to generate spam, harassment, hate speech, sexual content involving minors, or any content unlawful under Irish or EU law.
• Resell, white-label, or redistribute the Service without our written permission.
• Use bots or automation to exceed plan limits.

Violations may result in suspension or termination without refund.

6. Your content

You retain ownership of every photo and text you upload (“Your Content”) and of every listing the Service generates from it (“Generated Output”). You grant us a limited, worldwide, royalty-free licence to host, transmit, and process Your Content and Generated Output strictly to operate the Service (e.g. sending photos to Anthropic for analysis, storing generated listings for you to retrieve, and posting to Etsy if you authorise it).

We do not use Your Content or Generated Output to train AI models.

7. AI-generated output — accuracy and your responsibility

AI output can be wrong. Generated titles, descriptions, tags, and SEO scores are suggestions — you are responsible for reviewing them before publishing, and for ensuring the final listing is accurate, lawful, and compliant with Etsy's rules and any platform you publish to. We make no guarantee that any specific listing will rank, sell, or generate revenue. Etsy SEO is determined by Etsy, not by us.

8. Etsy connection

If you connect your Etsy shop, you authorise us to use the Etsy API on your behalf strictly to publish listings you ask us to publish. Your use of Etsy is governed by Etsy's own terms and policies. Etsy is independent of Listybitsy; we are not responsible for actions Etsy takes on your shop, including suspensions or listing removals.

9. Service availability

We aim for high availability but the Service is provided on an “as is” and “as available” basis. We may need to schedule maintenance, change features, or temporarily suspend the Service. We will give reasonable notice when feasible.

10. Termination

• You can delete your account at any time by emailing [email protected].
• We can suspend or terminate accounts that violate these Terms or that are inactive for 12+ months on the Free plan.
• On termination we will delete your account data within 30 days, subject to legal retention requirements (e.g. Stripe invoices kept for tax purposes).

11. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI OUTPUT. NOTHING IN THESE TERMS LIMITS RIGHTS THAT CANNOT BE LIMITED UNDER APPLICABLE CONSUMER LAW.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM AND (B) €100. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW (INCLUDING DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR ANY MANDATORY CONSUMER PROTECTION).

13. Indemnity

You agree to indemnify and hold us harmless from third-party claims arising out of your breach of these Terms, your misuse of the Service, your violation of Etsy's policies, or content you upload that infringes intellectual-property or privacy rights of others.

14. Governing law and jurisdiction

These Terms are governed by the laws of Ireland, without regard to conflict-of-laws rules. Disputes are subject to the exclusive jurisdiction of the courts of Ireland, except:

• If you are a consumer in the EU or the UK, you may bring claims in the courts of your country of residence, and you retain the protection of any mandatory consumer law in your jurisdiction.
• If you are a consumer elsewhere (including the United States), nothing in these Terms removes any non-waivable right or remedy you have under your local law.

Use of the Service is at your own initiative. You are responsible for compliance with your local laws to the extent local laws apply.

15. Changes

We may update these Terms. Material changes will be emailed to active users at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.
